Does a trust protect assets at divorce? | Cover Publications

Recently a client asked whether transferring assets to a Trust in the anticipation of a divorce will preclude those assets from being subject to division upon divorce?

Divorces are more often than not acrimonious in nature, fraught with emotion and an asset as insignificant as the silver cutlery that was gifted to the couple by a distant relative whose name is long forgotten becomes an issue of contention. It is therefore not surprising that one of the parties looks to a Trust as a vehicle in which to ?protect? his share of the assets at such a time.? The question is whether the transfer of the assets to a trust will achieve the desired purpose.

There are two manners in which a trust can be funded, either by donation in which case the founder of the Trust will have to pay 20% donations tax on any amount above R100 000-00, and by making an interest free loan to the Trust. This article will deal with the latter method.?

Joint ownership - The consequences of an in community of property marriage is that the assets in an estate are owned jointly regardless of who purchased such assets. The converse also applies in that a husband and a wife are jointly liable for the debts in an estate.? The founder of the Trust requires the consent of his spouse to sell or encumber any assets that are not excluded from their joint estate (e.g. assets inherited by a spouse in which the bequest specified the exclusion of the assets as forming part of the joint estate). Assuming that the spouse grants consent and the assets sold form part of the joint estate, upon such sale the value of the loan account will be an asset in the joint estate and be subject to division upon divorce.

Where parties are married out of community of property, they each retain assets in their own estates, and the transfer of assets into a trust by one spouse will not affect the estate of the other spouse. However where such an out of community of property marriage is subject to accrual, the spouse with the smaller estate may share in the growth of the estate of the spouse with the larger estate upon the dissolution of the marriage, in this case by divorce. As discussed above the assets that are sold by the founder of the Trust will be replaced by a loan account to the value of the amount of the sale of the assets.

Should the founder have the larger estate the spouse with the smaller estate will be entitled to share in such growth, which ultimately includes the loan account.

As illustrated above the transfer of assets to a trust will not exclude those assets from division upon divorce. The Constitutional Court and Supreme Court of Appeal dealt with the issue of divorce in relation to trusts in the cases of Jordaan v Jordaan 2001 (3) SA 288 (C) and Badenhorst v Badenhorst [2006] 2 All SA 363 (SCA) respectively, and held that the trusts in both cases were the founders? alter ego in that the founders had treated the trust assets as their own and were therefore subject to division at divorce. These cases do not deal with the transfer of assets in anticipation of divorce however the principle that is common in both cases is that the court will not allow spouses to ?hide? behind a trust. If assets are transferred into a trust for the sole purpose of ensuring that a spouse does not benefit at divorce I am sure that the courts will not hesitate to take the same view as that of Jordaan and Badenhorst.?? Trusts have various uses and benefits ranging from pegging the value of your estate, providing for minor children, tax planning, protecting your assets and preserving wealth for future generations, however they are not a ?quick fix? solution.? It is vital that appropriate advice is sought to determine whether a Trust is suitable for your estate planning.

Is there any way i can find out who the domain is registered with and how to go about changing permissions for access to editing the site?

You can use http://whois.domaintools.com/ to find out where the domain is registered, you will see it under "Registrar"

The easiest way to get ownership if the account is to get the ex colleague to transfer it over to yourselves, if this is not an option I'm sure you can talk to the registrar of the domain.

The easiest way is to find the registrar as above, sign up for a free account with the registrar, then ask your ex-colleague to push the domain name to your account there.

I understand life's not always that simple. You might have to remind him that theft is a crime that police prosecute. You might even be able to get a nice copper to have a chat with him if it comes to that. If even that doesn't work you might be able to get a mean one to talk to him.

As techhive said, the registrar will probably sort if for you if necessary as well. It would help if you have proof that the name was originally bought with company funds (credit card receipt, etc).

I don't understand that some people think the web is outside the law (or that they can leave their morality at the login screen).

All the answers so far have been advice on finding out where the domain is registered, not who is hosting it.

If the web host is handling DNS then just looking at the nameservers at the registrar might be enough, but DNS addresses can be elusive. It might be necessary to resolve the IP address of the domain by doing a ping, then do a lookup for the IP address.

If an IP address is part of a large leased block then you might have to email the company who leased the block and ask who the IP address is subleased to.

The express tool there gets all the info, from the domain registrar to the company the IP address block is registered to. From there you might have to send out a few emails to trace it even further if it's not listed there directly.

Yes, when I do that for any of the domains I host in my VPS it says the colocation center who owns the IP block is hosting the domain. Of course my IP address is leased by the colocation center to my VPS host, who in turn leases it to me, which I use for shared hosting clients.

Whoishostingthis.com reports two levels above me, but it would be necessary to contact me directly to change the authentication information needed by the original poster.

What I'm fond of doing is, whois.domaintools.com/[your domain name] while searching for WHOIS of a domain. Most of the people here suggested that - didn't know the DomainTools site was that popular. You'd get quite a lot of useful information here including Registrar's name.

Fast forward to the past: NASA technologists test 'game-changing' data-processing technology

ScienceDaily (Nov. 27, 2012) ? It's a digital world. Or is it? NASA technologist Jonathan Pellish isn't convinced. In fact, he believes a computing technology of yesteryear could potentially revolutionize everything from autonomous rendezvous and docking to remotely correcting wavefront errors on large, deployable space telescope mirrors like those to fly on the James Webb Space Telescope.

"It's fast forward to the past," Pellish said, referring to an emerging processing technology developed by a Cambridge, Mass.-based company, Analog Devices Lyric Labs.

So convinced is he of its potential, Pellish is meeting with scientists and engineers to explain the technology's capabilities and is using fiscal year 2013 NASA Center Innovation Fund resources to build printed circuit boards that researchers can use to test the technology's performance for a range of scientific applications. Pellish works at NASA's Goddard Space Flight Center in Greenbelt, Md. He also has carried out preliminary radiation-effects studies to see how the technology's architecture holds up under the extreme environment encountered in space.

"I wouldn't do it unless I really believed in it," Pellish added. "This is one of the few things I've seen that is really different than what others are trying to do. I think this technology could fundamentally change the way we carry out onboard processing."

Analog-Based Microchip

The new technology is an analog-based microchip developed with significant support from the Defense Advanced Research Projects Agency (DARPA). Instead of relying on tiny switches or transistors that turn on and off, producing streams of ones and zeroes that computing systems then translate into something meaningful to users, the company's new microchip is more like a dimmer switch. It can accept inputs and calculate outputs that are between zero and one, directly representing probabilities, or levels of certainty.

"The technology is fundamentally different from standard digital-signal processing, recognizing values between zero and one to accomplish what would otherwise be cost prohibitive or impossible with traditional digital circuits," Pellish said.

The processor's enhanced performance is due to the way the technology works, he explained. While digital systems use processors that step through calculations one at a time, in a serial fashion, the new processor uses electronic signals to represent probabilities rather than binary ones and zeros. It then effectively runs the calculations in parallel. Where it might take 500 transistors for a digital computer to calculate a probability, the new technology would take just a few. In other words, the microchip can perform a calculation more efficiently, with fewer circuits and less power than a digital processor -- attributes important for space- and power-constrained spacecraft instruments, Pellish said.

Although "there has been an overwhelming amount of positive support for the technology within Goddard" since Pellish began introducing colleagues to its capabilities, he is the first to concede that the technology isn't appropriate for all space applications.

Fast Fourier Transform

Because of its efficiency and inherent design, however, it's especially ideal for computing fast Fourier transforms (FFTs), and more particularly the discrete Fourier transform, a ubiquitously used mathematical algorithm in digital-signal processing. Among other things, Fourier transforms decompose signals into their constituent frequencies and are used to generate and filter cell-phone and Wi-Fi transmissions as well as compress audio, image and video files so that they take up less bandwidth.

Among other products, the company has developed an analog-based integrated circuit geared specifically for computing Fourier transforms. The team will use the technology, which the company donated, to assemble several custom circuit boards. "We'll take the hardware and see what it can do with our data and applications," Pellish explained.

One of the first applications the group plans to target with a version of the FFT integrated circuit is wavefront sensing and control, the computational technique for aligning multiple mirror segments, like those that are flying on the Webb telescope, so that they operate as a single mirror system.

In addition, Jeffrey Klenzing, who works with Goddard's Space Weather Laboratory, wants to evaluate the technology's use for on-board data processing, particularly for studies of the sun. "For a typical sounding rocket application, we send all data down and perform fast Fourier transforms on the ground. However, for satellite missions, this is not feasible given limited telemetry," Klenzing said. "A chip for performing rapid, reliable FFTs would be very useful for such heliophysics missions particularly with the push toward smaller, low-power satellites such as CubeSats and nanosats."

Pellish also believes autonomous rendezvous and docking and other applications requiring precise locational information would benefit from the analog-based technology. "We're trying to create a new market at NASA for analog processing. I believe it will give us a competitive edge. If we can push this, it could revolutionize how we do onboard data processing."

Failure Of India'S Big Rocket Project Is Symbolic Of Deep Structural Problems

The ongoing "Asia Pivot" by United States is rapidly changing the regional dynamics of the Indo - Pacific region, and nowhere is it more visible than the sphere of cooperation in defence and space research.

Recently Canadian and Australian defence co-operation and ties with India reached unprecedented highs, a chain of event termed as the "Rise of the Anglosphere" by historian Walter Russell Mead.

However, the successive failure of Indian GSLV missions, combined with India's stubborn secrecy and fierce independence in the space sector is giving rise to doubts about the scope of further future co-operations.

Although the failure of this signature launching vehicle is attributed to technical glitches, it is highly symbolic of the greater lack of clarity, purpose and direction in the Indian space program.

The Geosynchronous Satellite Launch Vehicle (GSLV) was originally intended to be India's signature launching vehicle, eventually to launch India's INSAT type satellites, and reduce dependence on foreign rockets.

In the early nineties, with the collapse of the Soviet Union, India was forced to develop independent launching vehicles. India originally tried to buy the technology to build a cryogenic upper stage from Russia, but was denied, under pressure from United States and other Western countries.

With the development of indigenous Cryogenic engine, India became the sixth country in the World to posses the technology, which could be potentially used for civilian and military purposes.

Indian GSLV generally uses L40 liquid strap on boosters and old Soviet KVD 1 upper stage. But even though Indian military and ballistic missile programs were successful, as recently evident with the successful launch of Agni V ICBM, its civilian rocket and space program were mediocre at best.

The Polar Satellite Launch Vehicle (PSLV), a launcher vehicle used previously to launch civilian satellites was used as a model of GSLV programs, but it was not successful. Multiple versions of GSLV were launched in the last decade, with more than half of them failing due to technical difficulties. A brief stint of success in 2003- 04 was followed by successive failures.

The vehicle failed to reach orbit, lost control of liquid fuel booster, veered of designated trajectory and had to be destroyed over the Bay of Bengal, or failed to deliver payload in the last four missions. With an unprecedented failure rate, GSLV is gradually on its way to be the costliest misadventure of Indian strategic and space sector. The eighth launch is scheduled in 2013.

The causes of these failures are minor, according to the official bureaucratic rhetoric, and were attributed to minor technical malfunctions. There was no clear response to queries as to why five out of seven launches have resulted in total or partial failure.

The Indian Space Research Organisation (ISRO) is also secretive and tightlipped about capability and weight of the satellites and why India is still unsuccessful in launching communication satellites more than 3000 KG, 36 Transponder class, whereas the nearby competitors like Japan and China, not to mention USA, Russia and European Space Agency have already moved on to triple that size.

There is no clarity and accountability when it comes to tax payer's money spent on space research, and no heads roll even when there are repeated failures. The lack of purpose is also evident as India lacks fixed and dedicated plan in the Space sector.

In an interview earlier this year, Dr. K, Radhakrishnan, chairman of ISRO, stated that India's main concern and thrust is in the area of applications and not manned space flights and space stations, unlike Russia, US or China. India with its massive population and democratic set up needs more communication satellite to cater to domestic needs, unlike China which is heavily centralized and controlled.

However that argument and logic falls flat as India is already planning for its second lunar mission in early 2014, Chandrayaan 2, and possibly a manned space mission by 2017.

In January 2011, the U.S. officially removed export controls on several subsidiaries of India's Defense Research and Development Organization and the ISRO. It was a clear signal that the United States would like to chart a new future of space co-operation with India.

American think tank Heritage Foundation also published a report around same time, calling for enhanced space and missile defence co-operation between India, Australia and United States, including satellite defence and interceptors, theatre based missile defence and most importantly future co-operation and joint space programs. However there seems to be lukewarm response and enthusiasm from the Indian side.

India's notorious reliance on Russian hardware is also a major hindrance when it comes to further cooperation with the West. Only with the benefit of hindsight would we be able to determine the trajectory of India's space co-operation with the West, or whether it takes any specific direction, but at this present point of time, it is safe to assume, that without any clear plan, or white paper, India's current space prospects are quite grim, and will continue in the chaotic and headless way for the near foreseeable future.

Funneling the sun's energy: New way of harnessing photons for electricity proposed

ScienceDaily (Nov. 26, 2012) ? The quest to harness a broader spectrum of sunlight's energy to produce electricity has taken a radically new turn, with the proposal of a "solar energy funnel" that takes advantage of materials under elastic strain.

"We're trying to use elastic strains to produce unprecedented properties," says Ju Li, an MIT professor and corresponding author of a paper describing the new solar-funnel concept that was published this week in the journal Nature Photonics.

In this case, the "funnel" is a metaphor: Electrons and their counterparts, holes -- which are split off from atoms by the energy of photons -- are driven to the center of the structure by electronic forces, not by gravity as in a household funnel. And yet, as it happens, the material actually does assume the shape of a funnel: It is a stretched sheet of vanishingly thin material, poked down at its center by a microscopic needle that indents the surface and produces a curved, funnel-like shape.

The pressure exerted by the needle imparts elastic strain, which increases toward the sheet's center. The varying strain changes the atomic structure just enough to "tune" different sections to different wavelengths of light -- including not just visible light, but also some of the invisible spectrum, which accounts for much of sunlight's energy.

Li, who holds joint appointments as the Battelle Energy Alliance Professor of Nuclear Science and Engineering and as a professor of materials science and engineering, sees the manipulation of strain in materials as opening a whole new field of research.

Strain -- defined as the pushing or pulling of a material into a different shape -- can be either elastic or inelastic. Xiaofeng Qian, a postdoc in MIT's Department of Nuclear Science and Engineering who was a co-author of the paper, explains that elastic strain corresponds to stretched atomic bonds, while inelastic, or plastic, strain corresponds to broken or switched atomic bonds. A spring that is stretched and released is an example of elastic strain, whereas a piece of crumpled tinfoil is a case of plastic strain.

The new solar-funnel work uses precisely controlled elastic strain to govern electrons' potential in the material. The MIT team used computer modeling to determine the effects of the strain on a thin layer of molybdenum disulfide (MoS2), a material that can form a film just a single molecule (about six angstroms) thick.

It turns out that the elastic strain, and therefore the change that is induced in electrons' potential energy, changes with their distance from the funnel's center -- much like the electron in a hydrogen atom, except this "artificial atom" is much larger in size and is two-dimensional. In the future, the researchers hope to carry out laboratory experiments to confirm the effect.

Unlike graphene, another prominent thin-film material, MoS2 is a natural semiconductor: It has a crucial characteristic, known as a bandgap, that allows it to be made into solar cells or integrated circuits. But unlike silicon, now used in most solar cells, placing the film under strain in the "solar energy funnel" configuration causes its bandgap to vary across the surface, so that different parts of it respond to different colors of light.

In an organic solar cell, the electron-hole pair, called an exciton, moves randomly through the material after being generated by photons, limiting the capacity for energy production. "It's a diffusion process," Qian says, "and it's very inefficient."

But in the solar funnel, he adds, the electronic characteristics of the material "leads them to the collection site [at the film's center], which should be more efficient for charge collection."

The convergence of four trends, Li says, "has opened up this elastic strain engineering field recently": the development of nanostructured materials, such as carbon nanotubes and MoS2, that are capable of retaining large amounts of elastic strain indefinitely; the development of the atomic force microscope and next-generation nanomechanical instruments, which impose force in a controlled manner; electron microscopy and synchrotron facilities, needed to directly measure the elastic strain field; and electronic-structure calculation methods for predicting the effects of elastic strain on a material's physical and chemical properties.

"People knew for a long time that by applying high pressure, you can induce huge changes in material properties," Li says. But more recent work has shown that controlling strain in different directions, such as shear and tension, can yield an enormous variety of properties.

One of the first commercial applications of elastic-strain engineering was the achievement, by IBM and Intel, of a 50 percent improvement in velocity of electrons simply by imparting a 1 percent elastic strain on nanoscale silicon channels in transistors.

The work was done with Ji Feng of Peking University and Cheng-Wei Huang, and was supported by the U.S. National Science Foundation, the U.S. Air Force Office of Scientific Research, and the National Natural Science Foundation of China.

Woman denies murder to avenge husband's death

A woman accused of luring a man to his death in revenge for her husband?s murder told a Florida court Monday that she acted in self-defense.

Janepsy Mesa Carballo, 35, who is on trial for second-degree murder, , told a Miami-Dade court that she feared that Ilan Nissim would harm her and her family when she shot him.

?In my mind, he was chasing me,? Janepsy Mesa Carballo said of Nissim. ?His people, as he called it, were chasing me.?

She testified in hopes of having her murder charge thrown out under Florida?s Stand Your Ground law.

Carballo said that she lived in fear of Nissim, who was an acquaintance and business partner of her husband, Orlando Mesa.

Shot six times in the back
Mesa and Carballo?s toddler son were shot outside their North Miami home in April 2008. Her husband was killed and their 2-year-old boy was injured but survived.

A month later, Carballo shot and killed Nissim inside her home, according to authorities.

Prosecutors say Carballo was out to avenge her husband's death, claiming that she lured Nissim to her home the night she fatally shot him six times in his back.

But Carballo said that she wasn?t expecting Nissim that night, and said that his visit turned violent. She acted in self-defense, she said.

There is always the potential for a disconnect between the Canadian public and its military which must be guarded against, says a former broadcast journalist and member of the Senate.

Pamela Wallin says she is concerned that with the combat mission in Afghanistan over, it would be easy for the public to develop an ?out-of-sight, out-of mind? attitude toward the military.



?We have to make sure that the ties between our citizens and our military do not disappear,? Wallin told the crowd during an address Monday at the Scotiabank Convention Centre in Niagara Falls. ?That?s why we?re here today. We have to know why a country has a military. You have to know where you?re freedoms come from and sometimes we lose that connection?so it is up to us.? Leadership and maintaining this connection ? is the responsibility of all of us.?

Wallin, chairwoman of the Senate?s National Security and Defence Committee and member of the Veterans Affairs and International Trade Committee, was the keynote speaker at an event hosted by the Garrison Community Council of Niagara, an organization dedicated to building closer connections between Canadians and the military.

?The disconnect is somehow tied to the fact that when you?re in combat it?s on the news every night ? and people tend to connect. But the larger issue is when it?s not that the folks who are in our public life like our MPs, our senators, our leaders ? they don?t have those direct ties and connections to the military.? They don?t think about it.?

That?s a far cry from the days when large portions of the House of Commons and the senate were filled with veterans who had actually served and ?appreciated what the Canadian Forces means to our national interests.

?During World War One, one-tenth of our population signed up to serve. And after the war the veterans continued to play a prominent part in our society. But pretty soon the Second World Wars and the Koreas started fading from memory.?

Wallin cited several changes that contributed to the further separation of military ideals with the public, including the new peace-keeping ideology, which started in the 50s, and the unification of the Canadian forces, which began in the days of the Pearson government and killed off many reserves. She said the disappearance of military programs from university campuses during the Vietnam War further marginalized soldiers from the population at large.

?Again this vital citizen-military link at our universities, at that crucial age was just disappearing and has not yet been re-established.?

Even the end of the Soviet Union was led some to question the need for an expensive military.

?There seemed to be fewer enemies and defence was seen as a lesser priority and so the 90?s in order to balance the books the government drastically and disproportionately cut military spending.?

Wallin quoted former Canadian Gen. Rick Hillier, who called the 1990?s ?the decade of darkness? as funding and public support dried up.

She told the group it was only after 9/11 that things began to turn around when the Canadian forces were engaged in going after the Taliban and helping to rebuild Afghanistan that public opinion turned to one of support for the troops.

She said the Canadian military helped build 52 schools in Afghanistan since 9/11, and assisted in essential skill building for many by teaching locals basic literacy skills.

?When those kids go back to their own communities with the ability to pick up a pen and write a letter or fill out a form, they are now the hero in their community ? not the drug lord and not the Taliban leader.?

LONDON???Could computers become cleverer than humans and take over the world? Or is that just the stuff of science fiction?

Philosophers and scientists at Britain's Cambridge University think the question deserves serious study. A proposed Center for the Study of Existential Risk will bring together experts to consider the ways in which super intelligent technology, including artificial intelligence, could "threaten our own existence," the institution said Sunday.

"In the case of artificial intelligence, it seems a reasonable prediction that some time in this or the next century intelligence will escape from the constraints of biology," Cambridge philosophy professor Huw Price said.

When that happens, "we're no longer the smartest things around," he said, and will risk being at the mercy of "machines that are not malicious, but machines whose interests don't include us."

Fears that machines could overtake humans have long been the subject of science fiction ? the computer HAL in the movie "2001: A Space Odyssey," for example, is one of film's best-known computer threats.

Price acknowledged that many people believe his concerns are far-fetched, but insisted the potential risks are too serious to brush away.

"It tends to be regarded as a flakey concern, but given that we don't know how serious the risks are, that we don't know the time scale, dismissing the concerns is dangerous. What we're trying to do is to push it forward in the respectable scientific community," he said.

While Price said the exact nature of the risks is difficult to predict, he said that advanced technology could be a threat when computers start to direct resources towards their own goals, at the expense of human concerns like environmental sustainability.

He compared the risk to the way humans have threatened the survival of other animals by spreading across the planet and using up natural resources that other animals depend upon.

Price is co-founding the project together with Cambridge professor of cosmology and astrophysics Martin Rees and Jann Tallinn, one of the founders of the internet phone service Skype.

The university said Sunday the center's launch is planned next year.?

However, it?s not simply good enough to just know how many people visited your site last week, you also need to know how many people who visited your site resulted in a conversion ? be it a sale, registration or an enquiry. In light of this, make sure you have conversion tracking in place in Google Analytics and if you can afford it, sign up to a call tracking programme that will be able to tell you exactly how many phone calls have been generated. This data will then give you a far greater understanding of your online business and give you the information you need to be able to make informed decisions.

The security of your site and the data collected off customers is of paramount importance. You don?t want your site being hacked, thus preventing you from making sales, so make sure things like passwords and hosting is secure. Also, you will need to be thinking about how you?ll be taking payments on your site. Make sure this is secure as well and if needs be, get someone on-board who specialises in e-commerce payments.

?10. Maintenance & Development

Finally you will need to think about the long game. In light of this, be sure you have the knowledge needed either internally to maintain a website and develop it further ? if you don?t have this in place, I would seriously recommend out-sourcing it to an appropriately qualified Web Developer to ensure your site works as needed for every possible customer visiting your site.
