Despite oil prices, falling euro, Dow closes up slightly

Oil prices fell, the euro sank to a 22-month low, and the yield on the U.S. government's 10-year Treasury note fell near a historic low. But the Dow Jones industrial average edged up 125 points to close at 12580 as investors continue to hope for a Chinese growth spurt.

On Tuesday, oil prices fell, the euro sank to a 22-month low, and the yield on the U.S. government's 10-year Treasury note fell near a historic low after a report suggested that Spain will have more trouble repaying its debts.

But stocks rose anyway. In fact, they had one of their best days in an otherwise dreary month. Investors focused on hopes that China is poised to rev up its economic growth machine and that upcoming elections in Greece will help the country stay in the euro.

"The overriding news isn't that great," said Robert Pavlik, chief market strategist at investment advisors Banyan Partners. "But Greece and China are taking the pressure off the market in the short term."

Gains in industrial stocks that depend heavily on the Chinese economy, like Caterpillar and Alcoa, helped push the Dow Jones industrial average up 125.86 points. The Dow closed at 12,580.69, up 1 percent.

China is the largest market for aluminum, which Alcoa makes, and Caterpillar recently said it is aggressively courting China to sell its construction equipment. Both stocks gained 3 percent.

It was only the fifth gain for the Dow this month. The index is down 4.8 percent for May and is headed for its first monthly loss since September. The main culprits behind the decline have been the increasing likelihood that Greece will drop out of the euro currency and a worsening of Spain's financial condition.

Facebook plunged 10 percent to $28.84, shaving $25 billion off from the company's market value in its first seven days of trading. The glitch-plagued IPO has drawn scrutiny from regulators and ire from disgruntled investors who had trouble executing trades.

Blackberry maker Research in Motion plunged 11 percent in after-hours trading to $10 after the company said it expects to post a loss in its first quarter amid tough competition in the smartphone business.

The Standard & Poor's 500 index closed up 14.60 points at 1,332.42, and the Nasdaq composite added 33.46 points to 2,870.99.

U.S. markets were closed Monday for Memorial Day.

Oil prices fell below $91 after ratings agency Egan Jones downgraded Spain's debt Tuesday. Crude oil prices have been dropping steadily from $106 four weeks ago amid signs of slowing global growth.

Analysts have been concerned that Spain and other weak European economies could drag the European Union into recession this year. It would lead to lower demand from Europe, a region that consumes 16 percent of the world's oil. It also could harm trading partners like the U.S. and China and slow down global demand for oil.

The same worries flagged in the report sent the euro to $1.246, its lowest point against the dollar since July 2010. Investors fled to the safety of U.S. government bonds, sending the yield on benchmark 10-year Treasury note as low as 1.71 percent, near an all-time low.

Stock investors on Tuesday appeared relieved with news from Greece that a party in favor of abiding by the terms of the country's financial rescue could win in national elections next month. That could avoid a catastrophic rift with Greece's international creditors and keep the struggling country within the euro zone.

There was also some positive news from the beleaguered U.S. housing market. The Standard & Poor's/Case-Shiller report found that home prices increased in 12 of the 20 cities it tracks. The increase in March from the month before was the first in seven months. It was the latest evidence of a slow recovery taking shape in the troubled housing market.

In Europe, concerns that Spain's ailing banking sector might worsen the European debt crisis sent the Spanish stock market to nine-year lows. Other European markets rose.

Spain's banks are sitting on huge amounts of soured investments in the country's imploded real estate market. That has led to the recent nationalization of Bankia, the country's fourth-largest lender. Bankia revealed last week that it needs far more money in state aid than previously expected, $23.8 billion.

Madrid's Ibex index fell 2.3 percent and Bankia dropped another 13.6 percent.

Other stocks that were making big moves:

? Interline Brands shot up 40 percent after the maintenance company said it is being acquired by a pair of private equity groups for about $811 million.

? Patriot Coal rose 6 percent after the company said its CEO is leaving the company. Last week Patriot announced that it is working with private equity firm The Blackstone Group after there were concerns that the mining company could run short on cash.

? ConocoPhillips rose over 2 percent after a Citi analyst said the company is likely to pay hefty dividends this year thanks to asset sales that generated higher returns than analysts expected.

I'll Have Another's trainer has a lot on his plate

Doug O'Neill said he slept "like a log" on the red-eye from California, and soon after landing in New York on Sunday, he saw his superstar colt for the first time in a week. I'll Have Another immediately brightened a rainy morning.

"He looked great," the trainer said at a news conference at Belmont Park. "His legs were ice cold and he cleaned up his feed tub. His coat looks great and his stride is terrific. We have all the confidence in him, and if he stays strong and healthy, he should be tough to beat."

The 3-year-old son of Flower Alley will try on June 9 to become the 12th Triple Crown winner, and the first since 1978, in the 1 1/2-mile Belmont Stakes. O'Neill is stunned to be aiming for racing immortality. "I can't believe I'm in this spot," he said. "I think I'm proof that if you have a great team and an amazing horse, miracles can happen.

"Winning the Santa Anita Derby, I didn't think life could get better than that. Then we won the Kentucky Derby and the Preakness. I think it takes a pretty special horse to do that, and if we're lucky enough to win the Triple Crown, I think he would be very deserving."

I'll Have Another jogged "4 or 5 furlongs" Sunday and galloped "about 7 furlongs," which O'Neill said will be his typical morning routine. He does not plan a timed workout before the Belmont. "I think the amount of energy he puts into his daily gallops is the reason why an official workout isn't important in my mind."

O'Neill spent six days in Southern California with his wife, Linette, and their children, Daniel, 9, and Kaylin, 7. The time recharging with the family wasn't without serious stress, however. On Thursday, the California Horse Racing Board suspended O'Neill for 45 days because his horse Argenta tested for an excessive level of total carbon dioxide after finishing eighth in an August 2010 race at Del Mar.

When asked if he had been "on pins and needles" while awaiting the verdict, O'Neill said, "I wouldn't say I was like O.J. or anything like that."

The CHRB agreed with O'Neill that there was no evidence Argenta received a "milkshake," racetrack slang for a mixture of baking soda, sugar and electrolytes administered through a tube down a horse's nose. O'Neill was suspended 15 days for a "milkshaking" violation that occurred in April 2010 with Stephen's Got Hope, who finished seventh in the Illinois Derby.

"I was thrilled the CHRB said what I'd been saying all along, that there was no wrongdoing," he said. "I'm not sure why I got suspended after they said that."

The ban will not begin until July 1 at the earliest. Asked whether he would appeal, O'Neill said, "We'll check out all our options after the Belmont and let the attorneys handle that question."

Besides focusing on the "Test of the Champion," Team O'Neill plans to have as much fun as possible. As he did in Louisville and Baltimore, owner Paul Reddam has rented a house for O'Neill and his assistant trainers -- his older brother, Dennis O'Neill, and Jack Sisterson -- and exercise riders, grooms and hot walkers. O'Neill would not reveal the location. "If I told you," he said, "I'd have to kill you."

The morning after the Preakness, Reddam emphasized the importance of continuing to stay loose. "I have no idea what's going to happen between now and June 9," he said. "So my advice to everyone is to keep the tension down. This game is supposed to be fun, and we don't need to try to win the Triple Crown with a heavy heart."

Diablo 3 had huge opening sales. Unfortunately for them, it wasnt as smooth as the players or Blizzard themselves would have hoped for. Not only were the servers down at launch, but there are numerous reports of hacked accounts and now to top it off, the auction house has been delayed again.

Blizzard has announced that with the ongoing issues, they are holding off on launching the Auction House?indefinitely.

?In light of the post-launch obstacles we?ve encountered, we have made the decision to move the launch of the real-money auction house beyond the previously estimated May time frame, as we mentioned in our original announcement, our goal has always been to ensure everyone has the smoothest experience possible when the real-money auction house launches, and we need a bit more time to iron out the existing general stability and gameplay issues before that feature goes live.?While we don?t have a new launch date to share just yet, we?ll have more information soon.?

Myanmar power protests put government to the test

BANGKOK (AP) ? Protests this past week in Myanmar over persistent power shortages have provided a test of how the country's elected but military-backed government will respond to rising expectations sparked by democratic reforms.

Small demonstrations in Myanmar's two largest cities and several towns could be seen as an indicator of the new openness under President Thein Sein, who has overseen the country's emergence from decades of authoritarian rule and diplomatic isolation.

From another point of view, the protests, which have been peaceful and limited in size and scope, serve as a reminder of the early stages of past unrest ? small affairs sparked by complaints over the economy that snowballed into large-scale challenges to authority.

In 2007, the former military regime used force to put down the so-called Saffron Revolution led by Buddhist monks. That rebellion began as small, localized protests over fuel price hikes.

"Protests like this in Myanmar always have the potential to escalate and lead to political unrest," said Trevor Wilson, a former Australian envoy to Myanmar who now teaches at Australian National University. "It is hard to predict how these protests might develop."

Thein Sein was prime minister of the military government, but shed his formal links with the army to run with its proxy political party in a 2010 general election that was boycotted by the party of democracy leader Aung San Suu Kyi.

Last year, Thein Sein embarked on a reform program whose main objective was to win the easing of economic sanctions imposed by the United States and the European Union against the previous repressive military regime. That goal has already been largely accomplished.

Also as a result of the reforms, the government won the cooperation of Suu Kyi, the once-implacable foe of army rule. Suu Kyi and her National League for Democracy party even agreed to run for parliament in by-elections, snaring 43 seats in last month's polls to play a small but historically significant legislative role.

Along with the revival of parliamentary politics in Myanmar there has been a new assertiveness in civil society, especially in lobbying on environmental issues. One campaign, opposing the Chinese-funded Myitsone hydropower dam on the Irrawaddy River, won an astonishing victory when the government announced the cancellation of the project.

Still, the potential for conflict in Myanmar ? also known as Burma ? lies in the space between the political reforms achieved so far and the shortfall in other fundamental changes, particularly in the economy.

Speaking Tuesday at the opening of a branch office for her party, Suu Kyi said "the country suffers from power shortages because of mismanagement. I believe that the system has to be changed to get electricity or to get water or to get jobs."

The challengers to the government are the same activists who used to struggle against military rule, but are now emboldened by the new democratic opening.

Their antagonist is the same military that smashed their dreams five years ago. Though he came to power through election, Thein Sein heads a government that serves at the sufferance of the military, which together with its civilian allies controls parliament and security affairs.

The immediate prospects for strife are hard to calculate. The protests have been peaceful and relatively unassertive so far, with the crowd in Yangon ? Myanmar's biggest city ? topping out at about 300 on Friday night.

But out of habit, deliberation or misunderstanding, the authorities are clearly nervous. In the central city of Mandalay, Special Branch political police held several protesters briefly for questioning.

On Thursday in the central town of Pyay, police pressure on demonstrators led to a brawl and six arrests. The angered comrades of those detained gathered outside the local prison until the detainees were released, then carried on protesting.

"Police violence encountered during the protests against power cuts shows just how Burma continues to grossly neglect and violate the basic rights to human dignity and freedom of expression," said the Thailand-based Assistance Association for Political Prisoners (Burma), a group that feels reforms have fallen way short of what is desirable. "It is clear that peaceful dissent is still not tolerated."

Others are not so pessimistically inclined.

"The timing of these protests is interesting because the new laws about peaceful assembly are in place and the new government's attitude is different from that of its predecessors," said Australian National University's Wilson. "One would expect both sides to be more reasonable and tolerant now, and early signs are that this seems to be the case."

Thein Sein's reforms included the passage of a bill allowing citizens to stage peaceful demonstrations ? although still-existing security laws continue to put protesters at legal risk.

Myanmar has suffered from power shortages for more than a decade. It has plentiful natural gas supplies, but a poor power distribution infrastructure that has lagged even more as the economy has grown.

Sean Turnell, an economist at Australia's Macquarie University, said he believes what is significant about the current protest movement is "how it highlights the way that economic reform, and the changes that need to be made to make life easier here for the great bulk of people, are seriously lagging."

Up to now, much of Myanmar's natural gas has been earmarked for neighboring Thailand and China, he noted.

"For the previous regime, domestic considerations and the lives of the citizenry (as well as domestic business) took a back seat to the desire to secure foreign exchange," Turnell said. "The current government, I think, is hopeful of doing something better, but at the moment the legacy of the past is weighing on them."

Suu Kyi has endorsed the protests, which have seen demonstrators holding candlelight vigils and marching in public streets.

"However, according to law, you have to ask permission to march in procession," she said. "If people have to get permission to march, everyone should express their feelings by standing in front of their houses with candles in their hands, so that no one can object to it."

Speaking to a large crowd Friday evening as she opened a party branch office in western Yangon, she said a government should be accountable to the people and should apologize if it cannot fulfill their wishes.

At the national level, Myanmar's government has come close to doing just that, retreating into a defensive posture with various explanations in the state-run press seeking to explain the power shortages and spelling out plans to alleviate them. The plea for understanding contrasts sharply with the tone-deaf attitude usually taken by the previous military government.

"The new Myanmar government is likely to be more concerned about the welfare of its citizens, and more disposed to remedy the source of any problem like power shortages," Wilson said. "It might even reverse previous government policies."

Senate committee cuts Pakistan aid over conviction

WASHINGTON (AP) ? A Senate panel expressed its outrage Thursday over Pakistan's conviction of a doctor who helped the United States track down Osama bin Laden, voting to cut aid to Islamabad by $33 million ? $1 million for every year of the physician's 33-year sentence for high treason.

The punitive move came on top of deep reductions the Appropriations Committee already had made to President Barack Obama's budget request for Pakistan, a reflection of the growing congressional anger over its cooperation in combatting terrorism. The overall foreign aid budget for next year had slashed more than half of the proposed assistance and threatened further reductions if Islamabad failed to open overland supply routes to U.S.-led NATO forces in Afghanistan.

Pushing aside any diplomatic talk, Republicans and Democrats criticized Pakistan a day after the conviction in Pakistan of Shakil Afridi. The doctor ran a vaccination program for the CIA to collect DNA and verify bin Laden's presence at the compound in Abbottabad where U.S. commandos found and killed the al-Qaida leader in May 2011.

"We need Pakistan, Pakistan needs us, but we don't need Pakistan double-dealing and not seeing the justice in bringing Osama bin Laden to an end," said Sen. Lindsey Graham, R-S.C., who pushed for the additional cut in aid.

He called Pakistan "a schizophrenic ally," helping the United States at one turn, but then aiding the Haqqani network which has claimed responsibility for several attacks on Americans. The group also has ties to al-Qaida and the Taliban.

"It's Alice in Wonderland at best," said Sen. Patrick Leahy, D-Vt. "If this is cooperation, I'd hate like hell to see opposition."

One of the most forceful statements came from Sen. Dianne Feinstein, D-Calif., who also serves as the chairwoman of the Senate Intelligence Committee. She pointed out that Pakistan has suffered at the hands of terrorists yet misconstrued what is treason in convicting Afridi. She also insisted that Afridi was not a spy.

"This conviction says to me that al-Qaida is viewed by the court to be Pakistan," said Feinstein, who said it made her rethink U.S. assistance.

The Appropriations Committee approved Graham's amendment to cut the assistance by $33 million on a 30-0 vote. The full Senate will vote on the overall bill, possibly this summer.

At the State Department, Secretary of State Hillary Rodham Clinton said the United States believes Afridi should be released.

"His help was instrumental in taking down one of the world's most notorious murderers that was clearly in Pakistan's interest as well as ours and the rest of the world," Clinton told reporters, adding that the United States will continue to press the issue with Islamabad.

In crafting the overall legislation, the committee reduced Obama's request to aid Pakistan by 58 percent as resentment and doubts linger on Capitol Hill a year after bin Laden was killed deep inside Pakistan. Tensions between Washington and Islamabad have increased as Pakistan closed overland supply routes to Afghanistan after a U.S. attack on the Pakistani side of the border killed 24 Pakistani soldiers in November.

The United States and Pakistan failed to resolve the issue at the recent NATO summit in Chicago.

The congressional anger over the conviction and the supply routes extended to the Senate Armed Services Committee, which completed a $631.4 billion defense budget Thursday. The panel added a provision stipulating that before Pakistan can be reimbursed with coalition funds, the secretary of defense must certify that Pakistan is opening and maintaining the supply routes, is not supporting the Haqqani network, and not detaining or imprisoning Pakistani citizens, according to Sen. John McCain, R-Ariz.

He referred to the conviction as a virtual death sentence.

The fierce congressional response in various committees "shows a common outrage," Sen. Carl Levin, D-Mich., told reporters.

Members of the Senate Appropriations Committee also complained about mafia-style extortion by Pakistan in seeking truck fees in exchange for opening the supply lines. The cost had been $250 per truck prior to the attack. Pakistan is now demanding $5,000 per truck. The United States has countered at $500.

The bill would provide just under $1 billion in aid to Pakistan, including $184 million for State Department operations and $800 million for foreign assistance. Counterinsurgency money for Pakistan would be limited to $50 million.

The legislation also conditions the counterinsurgency aid on Pakistan reopening the supply routes.

Islamabad won't get any of the funds for counterinsurgency or money in prior legislation unless the secretary of state certifies to the Appropriations committees that "the government of Pakistan has reopened overland cargo routes available to support United States and North Atlantic Treaty Organization troops in Afghanistan, and funds appropriated under this heading can be used efficiently and effectively by the end of the fiscal year," the legislation says

If the secretary can't certify to Congress, the money would be transferred to other accounts.

The overall legislation would fund the State Department, foreign operations and other programs at $52.1 billion, which is $2.6 billion less than what Obama requested for the 2013 fiscal year beginning Oct. 1 and $1.2 billion below current spending.

Wading into the dispute over Palestinian refugees, the panel approved a version of an amendment from Sen. Mark Kirk, R-Ill., that would require the secretary of state to submit a report to Congress on the number of Palestine refugees who were displaced by the 1948 Arab-Israeli conflict, the number of descendants and who receives assistance from the United Nations Relief and Works Agency.

The issue of whether to count refugees and their descendants is a divisive one. Some 5 million Palestine refugees receive assistance from the U.N. agency. A third of registered refugees live in camps in Jordan, Lebanon, Syria, the Gaza Strip and the West Bank.

The State Department and Jordan opposed the original Kirk amendment and it was modified by Leahy.

Ex-detainee: Syrian prisons are 'slaughterhouses'

AMMAN, Jordan (AP) ? A prominent Palestinian writer who was jailed in Syria for nearly three weeks described the facilities as "human slaughterhouses," saying security agents beat detainees with batons, crammed them into stinking cells and tied them to beds at night.

Salameh Kaileh, 56, was arrested April 24 on suspicion of printing leaflets calling for the ouster of Syrian President Bashar Assad, who is fighting a 15-month-old uprising against his rule. Kaileh's story offers a rare inside glimpse into the conditions faced by detainees held by the country's feared security services.

"It was hell on earth," Kaileh told The Associated Press on Sunday, nearly a week after Syrian forces released him and deported him to Jordan. Speaking at his friend's home in an Amman suburb, Kaileh had bluish-red bruises on his legs, which he said were the result of beatings with wooden batons that were studded with pins and nails.

"I felt I was going to die under the brutal, savage and continuous beating of the interrogators, who tied me to ropes hung from the ceiling," said Kaileh, a soft-spoken man with a shock of white hair who appeared frail, barely able to stand on his feet.

Born in Birzeit, West Bank, Kaileh has suffered under the regime in Damascus before. He was imprisoned by the Syrian government in 1992 for eight years because of his alleged links to underground Syrian communist and leftist opposition groups. A well-known leftist, he has written books on subjects ranging from Marxism to Arab nationalism.

This time, he was held in at least four detention centers after security forces arrested him at his home in Damascus, the Syrian capital where he's lived for more than 30 years.

Kaileh denied printing the leaflets, which he said angered the regime because they read: "For Palestine to be free, Syria's regime has to fall."

Syria often has touted its support of the Palestinian cause to boost its credentials as a bastion of Arab nationalism.

Kaileh's detention caused an outcry by Arab intellectuals, who called for his release and lashed out at Assad ? whose crackdown has not spared other intellectuals and artists.

Ali Ferzat, a political cartoonist whose drawings expressed Syrians' frustrated hopes for change, was beaten by masked gunmen as he left his Damascus studio last August. The assailants broke his hands and dumped him on a road outside Damascus.

A group of intellectuals and artists, including Syrian actress May Skaff, were rounded up and jailed for a week last summer after holding a protest in Damascus.

Recalling his arrest, Kaileh said Syrian intelligence stormed his house in an upscale Damascus district shortly after midnight. "They handcuffed and blindfolded me, took my three laptops, cell phones and any shred of paper they could lay their hands on."

"I told them I had nothing to do with the leaflets, but the interrogators insisted that they had information I was distributing them and that I had printed them out," he said.

He said Syrian security wanted to intimidate him by being "disdainful to Palestine and the Palestinian people, cursing us and saying the Israelis were better than us."

In one of the detention facilities in Mazeh ? a Damascus suburb ? Syrian security threatened they will "rape me and tape it to put the clip on the Internet," he said.

Rights groups have accused the Syrian government of torture of detainees. Claudio Grossman, the chairman of the U.N.'s Committee Against Torture, said this month that the Syrian government has carried out widespread killings, torture in hospitals, detention centers and secret detention facilities, as well as torture of children and sexual torture of male detainees.

Kaileh said he shared a cell with at least six army defectors and several doctors who had treated wounded civilians.

At night, he said he heard other prisoners "cry and scream while they were beaten."

Days later, Kaileh said he was admitted to a government hospital to treat his leg wounds. There, the conditions were "worse than in the detention centers."

He said he was squeezed into a small room with 30 other prisoners, mostly activists who allegedly participated in anti-government protests.

"The room was barely enough to accommodate five people," he said. "It was filled with body stench, dirt, urine and stool. Two people shared small beds and were tied to them, the food was lousy and we couldn't eat properly because our hands and feet were handcuffed day and night."

"We were not allowed to go to the restroom," he said. "Still, we were beaten if we urinated in our sleep."

"The detention facilities I was taken to were human slaughterhouses," Kaileh said.
